簡單來說
幫助犯和正犯都是在製造利益實害
所以沒有不法層次上的區別
二者的區別在於責任層次
用一不精確的說法
被幫助者相對於幫助者,在是否要讓事實實現上,是居於決定者的地位
幫助者是一個沒有決定權的人
也因如此
幫助者有一定機會會進入一種對社會規範無思維的「代理人狀態」,在心理上自我工具化
(他舉的例子是要求不知情的老師對答錯問題的學生施以電擊)
造成期待可能性的降低
故在這種情況下我們讓幫助者責任減輕
