The limits of the shelf established by a coastal : State on the basis of these recommendations shall be final and binding. : 這個組織本來就是聯合國負責認證海洋陸棚界限的委員會 : 結果你現在說CLCS說的不算？ : 不然請問你應該要聯合國哪個單位出來講才算？ : 看清楚 : The limits of the shelf established by a coastal state on the basis of these : recommendations shall be "final and binding". : 不知道final and binding是什麼意思可以去查查字典再來搞笑好嗎 UNCLOS第121條第3項說什麼？不能維持人類居住生活的岩礁，不能主張專屬經濟海域或大陸架。建議Scion可以先讀熟海洋法公約再來叫陣。由科學家組成委員會的CLCS是專門在處理「外大陸架的科學或技術問題」，就此部分同法第76條第8項的科學或技術所提的建議當然有拘束力，注意是科學問題有拘束力。但前提法律事實問題沒有解決，後面的科學或技術問題認定就是「廢話」。因為UNCLOS第121條第3項已經說的很明白了，「礁」是不能主張EEZ或大陸架的。你來跟我說依哪條國際法，CLCS有權決定任何島礁的法律性質為何？CLCS根本沒有這個權限。再者CLCS要來認定第76條第8項的基礎在同條第1項： The continental shelf of a coastal State comprises the seabed and subsoil of the submarine areas that extend beyond its territorial sea throughout the natural prolongation of its land territory to the outer edge of the continental margin... of 後面接什麼？ land territoy陸地領土，前提要件就是UNCLOS第60條人造島、第121條第3項礁，都不能產生EZZ跟大陸礁層。依維也納條約法公約第31條，本應依照UNCLOS公約上下文，來善意解釋UNCLOS第76條，只抓住第76條第8項不放，忘記上面有第60條、下面有第121條？簡言之，沖之鳥礁的法律地位根本沒有在CLCS中獲得解決退萬步而言，縱使肯認CLCS賦予日本沖之鳥大陸礁層確定界線，甘捕魚權何事？大陸礁層的權限，依UNCLOS第76條以下關於大陸礁層部分，僅在礁層的非生物資源開發，我國漁民又沒有去那裡挖石油，憑什麼逮人。最後，我有看其他文章似乎有引用某知名國際法教授見解認為不到10平方公尺的「沖之鳥礁」似乎可以認定是島，阿這位學者之前說51萬平方公尺的「太平島」不是島，是不是喝醉酒了！ -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 49.215.33.227 ※ 文章網址: https://www.ptt.cc/bbs/Gossiping/M.1461649465.A.7A4.html ※ 編輯: becool996 (49.215.33.227), 04/26/2016 13:48:12
