Recently, a teenager was raped and murdered by a repeat sex offender who
has just released from prison, which arose nationwide outrage and resulted
in fear and fright of individuals, especially when we knew that among 74
released sex offenders, four are unconnected for. On the ground of that,
authorities concerned as well as child protection organization urged Minis
try of Interior amend the Sex Assault Protection Act to prevent the traged
ies from happening again and child and women from potential threat posed by
released sex offenders. Certainly, regulating a completed Act needs time to
discuss to, but I think it is necessary and urgent that government should ma
ke proper measures to control the situation immediately, in my opinions, gov
ernment can consider following suggestions as its priority.
First of all, the released sex offenders should be forced to undergo compu
lsory medical treatment continuously regardless of when they committed the c
rimes. That is to say, the Act goes into effect retroactively.
Besides, the procedure of report between a prison and a police station sho
uld be faster and more effective than now .In addition, the polices are supp
osed to monitor the released sex offenders strictly and closely, undoubtedly,
those who committed sexual assaults and harassments are forced to report to
relevant authorities on schedule simultaneously.
The Last but not the least, it must controversial to introduce the Taiwanes
e version of Megan's Law. According to the Law, government has responsibiliti
es to public personal information of released offender (ex-convicts). Of cou
rse, some experts as well as Ministry of Interior consider this measure will
limit human rights extremely, in addition, it will contribute ex-convicts ha
ve no chances opportunity to re-enter society. And What is worse, the releas
ed sex offenders and their families maybe suffer from physical violence By con
trast, those who are parents merely just want their children to be far away fr
om harm and we all know that the sex offenders have morbid psychology resultin
g in committing again and again. That is, most of them are on a high recidivism
rate. Consequently, the majority of people believe that publicizing the inform
ation of released sex offenders is the best way to keep parents informed of po
tential dangers. Government has duty to find a balance between protecting huma
n rights of both potential victims and former sex offenders.
Frankly speaking, the government's power has its limit and no matter how muc
h detailed as well as strict the Act is. Obviously, it is just a punishment af
ter the crimes. It is said that prevention is better than cure; therefore, wh
ether the Legislative Yuan decides to passed the amendment of Sex Assault Pro
tection Act or not, the top priority is that we should definitely enhance mut
ual watch with each other. Only by doing so, do we live a life without fear e
ventually.
