[外電] PS變速問題多 美國Focus車主集體訴訟求償
PowerShift自手排變速箱問題多多,影響行車的安全性,維修也耗時耗力,
還拖累到車子的二手車價,讓廣大受害車主們損失慘重。
現在美國有7000名Focus和Fiesta車主,他們挺身而出,合作發起集體訴訟,
要向福特求償相關損失。
代表受害車主們的律師Ken Stern說,
「PowerShift變速箱危害到行車安全,車子二手價很差,車子無法提供可靠的運送功能
,浪費車主許多時間,以上種種都造成車主為數可觀的損失,
福特必須負起設計和製造上的相關責任。」
另外報導中有提到,在2014年時,美國福特已經延長PS變速箱的保固期限了,
從5年/9.6萬公里 延長到7年/16萬公里。

"Ford must be held accountable for design and manufacturing defects of
the PowerShift transmission that has compromised the safety of the vehicles
and cost owners significant loss in vehicle value, reliable transportation
and time," Ken Stern, founder and principal of Stern Law PLLC, said in a
statement.
In 2014, Ford has extended the powertrain warranty from five years/60,000
miles to seven years/100,000 miles.
◇檸檬車法案是消費者的利器
美國有「檸檬車法案」,車子如果有重大毛病,消費者就可以要求換新車,
目的就是為了保護弱勢的消費者,讓受害車主不會一面倒的被各大車廠欺負。
現在有PTT鄉民發起連署台灣版的檸檬車法案,可以去幫忙聲援,台灣的開車族要團結
,讓可憐的消費者不再被車廠欺壓,任人宰割。
「檸檬車法案」真的很有用,下面就是一個例子,變速箱故障,車廠就換一輛全新車。
美國有一輛Golf GTI 7代的DSG變速箱故障,後來福斯原廠就幫車主換一台全新車。

美國有一位無辜的車主,他的2015 Golf GTI的DSG變速箱掛掉了,
受害車主把車子送回原廠處理,並上網詢問網友意見。
他的GTI都是原廠狀態,完全沒有改裝過,也不曾激烈操駕過。
(註: 美規Golf GTI的濕式6速DSG是德國製造)
I read through at least two other posts in which MKVII owners experienced
similar issues with their DSG's. In my case, no tune, no mods, no hard driving.
美國鄉民jmargaretis回文建議說,只要DSG沒修好,受害車主就要用「檸檬車法案」
來施壓福斯原廠,要求換一台全新車。
Your scenario should be simple... a straight swap.
Keep anything and everything for a complete paper trail!
Turned in my MK6 on a lemon law. I'd get in touch with VWoA ASAP!
Have them flag your situation at the least and if they can't fix it
after 3 tries, then argue the lemon law! I'd be pissed!
為了幫車主修好Golf GTI,美國福斯說要從德國訂一顆DSG變速箱來幫車主換新維修。
但受害車主向美國福斯要求換新車,而原廠的態度似乎也傾向於配合車主的訴求。
Service department at my dealer confirmed earlier today that the
entire transmission needs to be replaced. Delivery from Germany is estimated
at 2 weeks. However, after filing a complaint with VWoA, it appears that they
are working some magic to try to get me into a replacement vehicle. Hope that
pans out. Will update.
結果原車主真的就從福斯那邊拿到一輛全新的Golf GTI。
由此可見「檸檬車法案」真的很有用,是弱勢消費者的利器。

顧客至上,天經地義!!
消費者是車廠的主人,不應該淪為被車廠欺壓的奴隸與信徒。
消費者不應該害怕向車廠爭取自身權益,而是車廠應該要害怕他的消費者。

目前還沒有很多PS受害車主想打官司求償,因為不確定是否划算。
況且這只是第一宗PS集體訴訟案,美國還有很多律師事務所也在等著看訴訟結果,
如果判決結果對消費者有利,那之後就會有後續效應,會有更多車主和律師出面求償

車主會和律師講定抽成比例,一般來說,美國律師的抽成比例約在33%~45%
但如果賠償金額非常高,那律師的抽成比例就可能降低到只有3%點多而已,
以美國2.0TDI柴油造假案為例,福斯集團和受害車主的和解金額是100億美元,
代表47.5萬名車主打官司的律師事務所的酬勞為3.325億美元,抽成比例只有「3.3%」。
