想請教關於H1b transfer再入境的問題,
我現在新公司準備要開始辦 h1b transfer, 而我想在上工前回台灣一趟
律師的說法是,
The prospective employee must be physically in the U.S. on the day we FedEx
the H-1B petition to USCIS, and throughout the end of the next business day
(when the petition is regarded as "filed"). After that, he/she is free to
travel internationally while the H-1B transfer petition is pending.
重點是, 依照這篇跟之前爬文的說法
若我要再進美國, 得等到我的 h1b transfer approved & 拿到新的i-797 才行
但律師說法是只要
presents at re-entry an unexpired Form I-797 approval notice for
the current H-1B; and
·is either still employed with that H-1B employer
and has a recent pay stub to prove it,
OR is in possession of the USCIS "receipt notice" for the 新公司 H-1B transfer
petition so he can work at 新公司 upon re-entry.
所以我真的可以只持舊雇主的I-797A + transfer receipt 就可以入境了嘛?
