[問題] 民營企業是否要遵守勞基法
目前老闆一直提到自己是民營企業
勞基法規定的是公家機關,所以與他無關
然後現在針對兩點有個問題
1.特休假
滿一年之後才有七天特休,之後不管做多久,特休都不會增加
2.加班時數
一個月內,有同仁加班到96個小時(但是是自願性)
一天的工作時間也曾經有超過12小時(含正常上班時間)
這兩點有違反勞基法應該是沒問題
但是難道勞基法管不到民營企業嗎?
