[請益] 挪移連續假日 是否也須徵得機關勞工同意
例如像今年228連假是從2/25放到2/28
其中2/27禮拜一的假是2/18禮拜六補上班後挪移到2/27去放的假
當然這是公務人員行事曆統一的規定
按勞動部的解釋,民間企業如果也要比照以上規定辦理時
必須徵得勞工的同意,還要經過勞資會議或工會同意才能照辦
否則2/18禮拜六未經過員工同意即要求上班
即使2/27給他放假,也恐有違反勞基法之虞
想請問公家機關的勞工是否也應該要照這個程序辦理?
在公家機關上班的勞工當然就是比照公家機關的行事曆
如果還要再徵得他們的同意才可以請他們在週六休息日上班
假如勞工不同意,那大家週六都在補上班,就他週六不上班
豈不是2/27就他自己一個人要去上班?機關會為他開門嗎?
如果真要比照這個規定才能辦理,真心覺得是荒謬至極
更別說機關勞工的薪資預算是去年編好的,勞基法卻是去年底才修法今年馬上上路
還要機關補發勞工的特休未休假工資,到底要去哪裡生來這筆錢?
勞基法修法還沒搞倒民間企業,公家機關自己先倒楣 XDD
