溪湖鎮長夫與女鎮代互毆互告 判決結果出爐
［記者陳冠備／彰化報導］彰化縣溪湖鎮民代表楊淑靜，對鎮長黃瑞珠老公楊鴻源經常出
入鎮長室行徑感到不滿，甚至公開質疑，兩人去年5月狹路相逢，一言不合吵起，楊淑靜持
起寶特瓶，對楊鴻源潑水並丟擲，楊鴻源則拿起塑膠椅砸過去，導致楊淑靜受有腦震盪，
楊鴻源有手腳挫傷等傷害，事後兩人互告對方傷害。彰化地院審理，楊淑靜處拘役50天，
楊鴻源處拘役55天。
判決書指出，楊淑靜於去年5月18日在臉書張貼質疑楊鴻源頻繁出入鎮長室之行為，引起楊
鴻源不滿，同月21日，楊男前往溪湖鎮民代表主席服務處，遇見楊淑靜與多人也在場，立
即對她興師問罪張貼內容，楊淑靜認為遭污辱，拿起裝有水的寶特瓶，對他潑水，楊鴻源
也不滿遭辱，拿起塑膠椅毆打楊淑靜，楊淑靜抵擋時又拿起裝有煙灰與水的寶特瓶，攻擊
楊鴻源，楊鴻源因此跌倒受傷。
眾人見狀立即將兩人拉開，而楊鴻源仍數度衝向楊淑靜，並用腳踹攻擊楊淑靜腹部，楊淑
靜審理時表示，為了閃避腳踢，結果跌倒，頭部撞到鐵製電風扇，導致腦震盪等傷害。
兩人皆坦承持物品攻擊對方，但否認有污辱之意，楊鴻源則稱，持塑膠椅是自我防衛。彰
化地院審理，現場至少有5人以上場合，楊淑靜潑水，並不具備侵害迫害性，楊鴻源持塑膠
椅反擊，不夠成立正當防衛，另外，楊鴻源遭眾人隔開後並放下塑膠椅，楊淑靜仍數次持
寶特瓶攻擊，也已構成對他人傷害。
法官審酌，兩人均為成年人，卻不思理性處理問題，兩人作為人民表率，僅因細故而犯行
，實不足取，因此量處以上其刑。
