其實光是這案子還需要大法官解釋你就知道美國人權也沒進步到哪去,但可以講 一下這東西的重點 就如文中說的,最高法院是要解釋1964民權法案的禁止工作歧視裡提到的"性別" 這個項目。也就是原本就有禁止歧視的法條了,只是保守派持的論點是法規說不 能因"性別"歧視,但同性戀這類是"性別認同"爭議,所以他們覺得我知道你是同 性戀後因此開除你是OK的 這次多數大法官意見就是認定你因為人家同性戀或變性而開除人一樣觸碰到了" 性別"這個點,所以認定違法。大法官沒有想重新定義"性別"這個詞,而是單純 說你這種歧視理由就是觸碰到了那個法規明文禁止的東西 然後為什麼這個東西意義重大呢?因為大家都知道美國現在大法官被川皇換了幾 個後自由派保守派是4:5,但這次結果卻是6:3,等於直接賞川普一個巴掌。也就 是川皇跟美國保守派以為換些大法官他們要操弄的各種爭議法案都能如他們所願 ,但現在發現這些人還是有基本價值跟專業的考量,沒有成為保守派夢想中替他 們合理各種歧視反墮胎擁槍等等議題的橡皮圖章 ※ 引述《ejrq5785 (ejrq5785)》之銘言: : 1.媒體來源:The Economist : 2.記者署名:The Economist : 3.完整新聞標題: : America’s Supreme Court protects LGBT workers against discrimination : 美國最高法院替LGBT團體捍衛工作權 : A momentous 6-3 ruling : 一個具里程意義的6比3判決 : 4.完整新聞內文: : https://imgur.com/3iNdbfd

Although the majority invokes the late Justice Antonin Scalia’ : s teaching that judges should pay heed only to the words of a statute, : Justice Alito wrote, “no one should be fooled” by the ruling.
