supreme court ruled that in cases of men harassing other men,a plaintiff
could win a suit if the alleged harasser was homosexual and therefore
motivated by sexual desire,if the harasser was motivated bu a general
hostility toward men,or if men where systematically treated differently from
women in the workplace.
in an odd twist,by the logic of this final criterion,an alleged harasser could
be innocent if he could show that he had equal contempt for men and women.
indeed,this defense was used successfully in 2000 in a case involving a male
supervisor who had punished a female employee for sleeping with him and threw
away a male employee's belongings when he didn't succumb to the boss's
advances. the court ruled that "conduct occurring equally to members of both
genders cannot be discrimination because of sex". the fact remains,however,
that cases of harassment constitute mate assertions of power over women.
