Texas A&M pitcher Barret Loux, the sixth overall pick in the June MLB draft, believed he had an agreement with the Arizona Diamondbacks to sign for $2 million when he and his parents visited Chase Field in Phoenix shortly after the draft. Instead, he was crushed by a failed physical exam and ignored by the Diamondbacks, who appear to be leaning on a controversial compensation rule that would enable them to get a do-over in next year’s draft. The situation has been a nightmare for Loux, who was willing to sign for less than the going rate for a No. 6 pick and just wants to begin his pro career. If the Diamondbacks don’t make him an acceptable offer by the Aug. 16 deadline for all draft picks to sign, he would have to spend next season in an independent league or return to college, then go back in the draft. Loux’ s predicament has piqued the interest of the MLB Players Association, possibly setting the stage for a decision that could have far-reaching consequences for big league teams and the amateur players they draft each summer. Loux had a breakout junior season for Texas A&M and it was widely predicted that he would be drafted near the end of the first round. Instead, the Diamondbacks took him much higher than anyone expected, in large part because they’d already agreed to a $2 million signing bonus, about $340,000 less than the “slotted” amount for a No. 6 pick. Once Texas A&M’s season completed, Loux was invited by the Diamondbacks to come to Phoenix. He figured he’d sign a contract and quickly be off pitching for Arizona’s low Class-A affiliate in Yakima, Wash. Loux and his parents declined comment, but, according to numerous sources, nothing went as planned. Loux was scheduled to meet with Diamondbacks officials for three days. The first day was to attend a game after a negotiating session to firm up the deal. The second day was to include a media event, an introduction to the fans, and most importantly, the signing of his contract. The third day was to wrap up the trip and get the ball rolling on his professional career. The trip didn’t get off to a good start. Loux had plush hotel accommodations, but inside Chase Field the reception was frigid. Loux didn’t meet with any high-ranking Diamondbacks officials the first day. He and his family were seated behind home plate, but weren’t invited to the owner’s luxury suite, a customary perk for top draft picks. The second day was worse. Loux began the day by meeting with Diamondbacks medical personnel. The examination revealed a tear in Loux’s labrum and spurred questions about his elbow – he had bone chips removed in the summer of 2009. The discoveries shouldn’t have taken the Diamondbacks completely by surprise: An MRI taken a week before the surgery to remove the bone chips was widely available to teams interested in Loux, Texas A&M trainer Josh Cohen said. Nevertheless, assistant general manager Peter Woodfork and then-general manager Josh Byrnes, who was fired a couple weeks later, informed Loux after the exam that the pre-draft offer was off the table. Loux returned home to Houston a day early and was very unsure about his future. He immediately sought a second opinion from the Texas Rangers medical team, which concluded that while he can pitch now, eventually the torn labrum could need repair and the elbow might need ligament-replacement surgery. For the next month he split time between Houston and College Station, Texas, working out and trying to take his mind off the draft and the Diamondbacks. A few days ago he joined the Cotuit Ketleers of the amateur Cape Cod League, the top proving ground for college players, but has yet to pitch. All summer long he engaged in a long-toss program, lifted weights and threw bullpen sessions. “He threw a bullpen every Tuesday during the season and went out there every Friday night,” Texas A&M coach Rob Childress said. “He stayed strong from start to finish and was low-to-mid 90s with his fastball the entire spring. He has every intention of moving to the next level and I hope that still will be the case. That really is what he wants to do.” Even good reviews from the Cape Cod League probably won’t prompt the Diamondbacks to make an offer. And other than feeling bad for the false promises they made to Loux before the draft, why should they? The two-year-old compensation rule states that if an organization fails to sign a high-round draft pick, it gets the same pick back in the next draft plus the pick in its normal draft order. Next June the Diamondbacks would get the No. 7 pick for not signing Loux, as well as either the third or fourth overall pick because of their woeful place in the standings. The rule was implemented to give teams leverage when negotiating with highly drafted players who waited until minutes before the mid-August deadline to sign. Sources say the rule was not intended to give a team incentive to stonewall a draft pick simply because they might not have done due diligence on his medical status. Next year’s draft happens to be loaded with premier arms, including TCU’s Matt Purke, Texas’ Taylor Jungmann, Virginia’s Danny Hultzen, Vanderbilt’s Sonny Gray and UCLA’s Gerrit Cole and Trevor Bauer. Loux must hope the MLB Players Association intervenes and either persuades the Diamondbacks to make an offer or persuades MLB to make him a free agent. At the least, Loux’s situation illuminates a problem with the compensation rule that could be addressed in the next collective bargaining agreement in 2011. And it also calls into question pre-draft agreements. Are the Diamondbacks under any obligation to hold to their $2 million agreement, does the medical exam negate it entirely, or should a compromise be reached? If Loux is left without an offer or free agency, it would appear he has two options – go back to A&M for his senior season or follow the path of Aaron Crow(notes) and Luke Hochevar(notes) and spend a season playing in an independent minor league before next year’s draft. Yet the NCAA might take a close look at his college eligibility given the involvement of the MLB Players Association. Independent ball might be his only choice, a far cry from the elation he felt when he learned the Diamondbacks had taken him with the sixth overall pick.
