[問題] 有人的公司明年休假已經先少七天了嗎?消失
年底要到了,明年度的行事曆也出來了
有人公司明年休假少七天的嗎?
上網查才發現
因為六大工商團體提案要求刪除勞工假日
勞動部修改勞基法施行細則
所以有些公司偷跑覺得一定會過
就直接明年休假少七天

勞基法第37條假日應休假,而在細則規定哪些是假日,
而若沒休假是可以的,但是要加倍發放工資,並不限於PT喔,這是要澄清的
至於科技業的人資採用變通方式就是刪掉彈性休假
請注意,這些都只是在討論最低限度的保障喔

XD 其實這件事情點出了行政權的強度跟速度
因為勞基法施行細則在法律上被定性為法規命令
也就是修改的話不需要過立法院,行政院就可以拍板決定啦
