[北美] F1 to J1? (have had immigration petition)
I apologize first for not being able to type Chinese with this computer.
Here is my (somewhat complicated) situation:
My husband and I are both in the U.S. right now, and he is working on OPT while
I am studying for my PhD on F1.
This year he did not win the H1B lottery, so he needs to switch some sort of
spouse VISA before his OPT expires.
Our ideal plan is this: I go back to Taiwain to change from F1 to J1 (I'm fully
supported by my school, and not subject to the "two-years" restriction), so
that my husband can apply for a J2 and then he will be able to work on EAD.
But here comes the problem:
My whole familyhas moved to to U.S. a few years ago, and my father even filed
an immigration petition for me in 2002. Although I have withdrawn the petition
(I just did it two weeks ago), I'm still worried that having this kind of
family and personal history will hinder our VISA application (or, precisely,
change of VISA category).
I guess my situation is kind of rare, but I'd really appreciate if anyone here
who has similar experience (either switching from F to J or applying a VISA
with immigration history) or understand the procedures can share some insights.
