中華民國存在論？中華民國擁有”台灣”主權？
San Francisco Peace Treaty holds Taiwan sovereignty in trust
International law specifies that the sovereignty of an area under
military occupation is held in trust by the principal occupying
power, and this is an interim status condition. Hence, the sovereignty
of the Taiwan cession was held in trust by the United States beginning
on October 25, 1945. The Republic of China is acting as the "agents"
for the United States military government in this arrangement.
國際法明定，一個被軍事力量佔領的地區主權，被”信託”於主要佔領的政權，而
稱為”過渡時期”狀態。因此，台灣主權從1945年10月25起”信託”於美國。而”
中華民國”則作為美方軍事政府的”代理人”於此項安排當中。
In December 1949, the government of the Republic of China fled to the
Taiwan cession, an area which its troops were holding under military
occupation, thus becoming a government in exile.
1949年12月，中華民國政府”逃”到台灣：一個藉由”軍事佔領”的區域，而形成
一”流亡政權”。
（意思就是指蔣介石政權只是一個從中國”流亡”到台灣領地的軍事政府，台灣主權尚未決定）
In Article 2b of the post-war San Francisco Peace Treaty, of April 28,
1952, Japan ceded "Formosa and the Pescadores", but no receiving country
was specified. However, Article 23 of the treaty clearly stated that the
United States was the principal occupying power, and Article 4b specified
that the United States Military Government had final disposition rights
over the Taiwan cession.
1952年4月28日，戰後舊金山合約第2b條，日本割讓出”寶島與澎湖群島”，但是沒
有接收國家被名定。然而，合約第23條清楚指出美國是主要佔領的勢力（政權）。而
第4b條則明定美國軍隊政府具有對於台灣領地的最終支配權。
In the Shanghai Communique of February 28, 1972, US President Nixon and
top PRC officials determined that the PRC was "the lawful government" of
the Taiwan cession. However specific details for the unification of the
Taiwan cession by the PRC and the Taiwan governing authorities were left
up to the officials of both sides of the Taiwan Strait to negotiate
separately. In this way, the United States arranged to make transfer of
the sovereignty of the Taiwan cession to the PRC.
1972年2月28日上海公報，美國總統尼克森與中國官員”決定”中國為台灣”具有法
律效力的政府”，然而關於台灣”被”中國統一的確切細節尚未提及，而台灣治理權
則是將由台灣海峽雙方官員協商。藉此，美國得以安排台灣主權授予中國之”轉讓”。

is essential both for the protection of the Charter of the United
Nations and for the cause that the United Nations must serve under the
Charter.
考慮到恢復中華人民共和國在聯合國的合法權利，對於維護聯合國憲章和聯合國組
織根據憲章所必須從事的事業，不可或缺。
Recognizing that the representatives of the Government of the People's
Republic of China are the only lawful representatives of China to the
United Nations and that the People's Republic of China is one of the
five permanent members of the Security Council,
承認中華人民共和國的代表是中國在聯合國組織的唯一合法代表，中華人民共和國
是安全理事會五個常任理事國之一。
Decides to restore all its rights to the People's Republic of China and
to recognize the representatives of its Government as the only legitimate
representatives of China to the United Nations, and to expel forthwith
the representatives of Chiang Kai-shek from the place which they unlawfully
occupy at the United Nations and in all the organizations related to it.
決定恢復中華人民共和國的一切權利，承認她的代表為中國在聯合國組織的唯一合法
代表。立即趕出(expel)蔣介石在聯合國組織及其所屬機構內的代表，因所有席位皆
非法佔有。
