[心得] 買二手車務必要求seller 提出smog check

敝人很不想要相信被騙, 所以也很努力地依照修車廠及smog check 廠的指示, 在freeway 以至少60 mph 以上的速度, 跑了60 miles, 前前後後跑了至少150 miles, 但結果一樣, check engine light 還是亮, 確定賣家在交車前有動手腳。 ok, 進入正題。首先必須說明的是, 美國這邊的車子, 要求廢氣排放必須符合一定的標準, 但它的標準並不僅止於 smog 本身, 還包括監測系統, 即OBD 二代,及車輛本身, 所以emittion test 過了, OBD 的function check 未必過, 其中一個沒過, 整個smog check 就會沒過。而OBD 沒過, Check Engin Light 就會亮, 依法令規定, Check Engin Light 一旦亮了, 就當然過不了smog check . 問題是Check Engine Light 亮的原因有百百種, 大概分二類: 1. OBD 沒壞, 所以引擎、觸媒轉換器或其他我不知名稱的零件壞了 2. OBD 本身的sensor 壞了. 而OBD 本身就是一個超複雜的系統. 它的確定方式, 就是用OBD scanner 去讀取OBD(接口在你的左膝處), 依照讀出來的codes, 就知道問題在哪裏。問題就是在這裏: 至少有二種以上的方法, 可以用OBD 把資料全部洗掉,亮號就不會亮了, 甚至把系統shut down (這種情形,即使你去跑60 miles 都不會重建數據) 則你買車前送車去車廠檢查時, 因為資料被洗掉, (重建方式就是至少再開60 miles) 即使車廠用OBD scanner 去讀, 也讀不到錯誤codes, 甚至於車廠根本就不知道要去 scan OBD, 結果就是交車時買車根本不會知道被騙, 直到過一陣子後Check Engine Light 亮起才知道(因為已經重建資料), 最遲當你去smog check 時就一定會被發現!! (不被發現的機率幾乎是0,檢查方式問題) 所以, 除非你在檢查車子時, 先把車子開個60 miles以上, 且在OBD沒被shut down下, 讓OBD 重新建立數據, 否則你在交車當時, 是不可能發現問題的。修復費用是多少? 如果只是sensor , 可能幾十元吧,甚至有網友自己換; 觸媒轉換器連工資650元, 外國人的店喊1000元以上; 引擎本身的問題則當然是1000元以上到不知多少錢; 附帶的是你會不會被車廠要求亂修一堆的風險。及心情超不爽! ok, 很貴的學費。雖然一眼就中意的車子, 引擎聲和變速感覺都ok, 但, 大家都要求smog check 是有道理的。若賣家拒絕: According to California state law at least, the seller is responsible for making sure the vehicle he/she is selling has/can pass a smog check. The seller is supposed to provide a certificate proving that the car passed a smog check within the past 90 days. A smog check "pass" is only valid for 90 days. If the seller does not provide the buyer with a valid smog check "pass" certificate and the car fails a smog check, the seller is responsible for the cost of all repairs to get the car to a "pass" state. There is no provision in CA state law for vehicles sold in an "as-is condition. " In fact, if a seller refuses to cooperate with a buyer, the buyer is encouraged by the state of California to take him/her to court, where he or she will be made to pay all repair costs. Section 24007 (b)(2) of the Vehicle Code states it is the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. There is no provision in the law to sell a vehicle "as is."
